Algorithmic Constitutionalism: Reimagining Human Rights, Democratic Accountability, and Public Governance in the Digital Age

Advances in digital governance technologies change how constitutional democracies, public institutions, and governance structures operate at local, national, regional, and global levels. Moreover, automated decision systems, predictive analytics, biometrics, and data-driven governance change public administration, judicial systems, welfare allocation/distribution, healthcare governance, and urban planning. Nevertheless, while digital governance technologies can increase efficiency in terms of administrative processes and improve policy development and service delivery, there are also significant issues raised about constitutional and human rights, including privacy, equality, transparency, accountability, surveillance, and democratic legitimacy, due to the widespread use of algorithmic governance tools/technologies. Further, the continued reliance on algorithmic governance may undermine traditional legal principles of due process, the rule of law, and participatory democracy. This article examines the legal and constitutional implications of governance under the age of algorithms. This article examines how digital governance systems affect constitutional rights, democratic accountability, and public governance in contemporary society. The research is conducted using a combination of methodologies, including constitutional principles, judicial opinions, international legal documentation, institutional reports, empirical studies, and various models of governance. The analysis relies on various methods of global governance. These include the European Union AI Act, the UNESCO Recommendation on the Ethics of Artificial Intelligence, the OECD Principles for Digital Governance, and enforcement methods in India and other countries. The study points to major deficits in explainability, algorithmic accountability, data protection, environmental sustainability and oversight in democracies. It draws on data on global digital governance, surveillance technologies, algorithmic bias and public trust in automated systems to help its arguments. The paper argues that constitutional democracies should adopt “algorithmic constitutionalism” based on transparency, human dignity, sustainability and accountability. The report finds that fragmented, sectoral regulations are ill-equipped to address the challenges posed by transnational technological risks. The paper proposes establishing a human-centred governance framework that integrates constitutional safeguards, sustainable development goals, environmental responsibility, and international cooperation
